Terms and Conditions for Online Contests Hosted by the Language Center of the University of Vienna
The contest is organized by the Language Center of the University of Vienna, operated by Innovationszentrum Universität Wien GmbH
By participating in the contest or other promotions hosted by the Language Center of the University of Vienna, Alserstraße 4, 1090 Vienna, on https://sprachenzentrum.univie.ac.at/, on facebook.com, on instagram.com, via medienportal.univie.ac.at, or through other online applications operated by the University of Vienna (e.g., Moodle), participants agree to the following terms and conditions and confirm that they have read and understood them.
To participate in the contest, participants must register personally on the respective platform. An active account is required for participation via Facebook/Instagram. Only participants with a Facebook/Instagram account representing a real person using their correct name are permitted. Participation using false identities or the identities of third parties is not permitted. Participation via the University of Vienna’s websites is not tied to a Facebook or Instagram account and may therefore be carried out by any person who meets the following requirements.
All natural persons with their primary residence in Austria are eligible to participate in the contest. Persons who have not yet reached the age of 18 (minors) require the consent of their legal guardians to participate.
By participating in the contest, participants are not obligated to purchase any product, nor will they incur any costs.
Participation in the contest is free of charge and independent of the purchase of goods or services. The odds of winning are not influenced by any actions taken by the participants.
Participants’ data will not be archived by the Language Center of the University of Vienna. After the contest has ended and the prizes have been awarded, the collected personal data will be deleted, unless there is a legal obligation to temporarily store the data. Participants are free at any time to revoke their consent to the storage of their data and thereby withdraw from the contest.
By participating, participants confirm that their submission to the contest (in particular images, photographs, texts, and drawings) does not infringe upon the rights of third parties, specifically copyrights, manufacturer’s rights, rights of use, and personality rights. If persons other than the participants are involved in the creation or development of the entry, the participants must obtain the consent of these persons prior to submission for the entry to be submitted and for any subsequent publication in connection with the contest.
The same applies in the event that third parties have been granted a right to the submitted entries. If individuals are recognizable in submitted photographs or drawings, participants must obtain these individuals’ consent to the submission and subsequent publication prior to submission, in accordance with personality rights.
Participants are responsible for ensuring that images, texts, or other content they upload do not violate applicable laws or infringe upon the rights of third parties.
By participating in the Language Center of the University of Vienna’s contest, participants grant, free of charge and irrevocably, the right to use the content they provide without any restrictions in terms of time, subject matter, or location. By participating in the contest, participants grant the Language Center of the University of Vienna the unrestricted right to use, edit, reproduce, distribute, make available, or publish, in whole or in part, the content or images provided by them.
Winners will be selected by random drawing by the Language Center of the University of Vienna and subsequently notified via a private message (email, messenger). In the event of a win, the winners expressly consent to the publication of their names.
The Language Center of the University of Vienna reserves the right to exclude from the contest any participants who violate the terms and conditions or attempt to influence the contest through technical manipulation or automated entries. Furthermore, the Language Center of the University of Vienna reserves the right to request proof from participants that they have met the terms and conditions. If the respective participants fail to provide such proof, the Language Center of the University of Vienna may exclude them from the contest. In the event of exclusion from the contest, prizes may also be revoked retroactively and reclaimed.
Furthermore, the Language Center of the University of Vienna reserves the right to make changes or additions to the contest or to cancel the contest entirely without prior notice. This applies in particular in cases of force majeure or if the contest cannot be held or continued for organizational, technical, or legal reasons. The Language Center of the University of Vienna is liable only for damages caused by willful misconduct or gross negligence. In particular, the Language Center of the University of Vienna is not liable for ensuring that the contest is actually accessible or that the offer is actually available on the Internet. The Language Center of the University of Vienna is not liable for any defects in the prizes donated by the cooperation partners. The entry deadline specified for the respective contest applies. Additional terms and conditions (such as the nature and duration of the contest, and the nature and scope of the prize) will be specified for each contest. Legal recourse is excluded; in particular, there is no legal right to participate in the contest. The prize cannot be redeemed for cash, exchanged, or transferred to other persons.
Winners will be notified no later than five business days after the contest’s entry deadline. If the contact information provided by the respective participants is incorrect (e.g., email addresses), the organizer is not obligated to track down the correct addresses. Any disadvantages resulting from the provision of incorrect contact information (incorrect email address) shall be borne by the respective participants.
Winners are required to confirm acceptance of the prize and request it no later than 14 business days after being notified of their win by the Language Center of the University of Vienna. Winners then have four weeks to claim their prize. Prizes must be picked up at the main office of the Language Center of the University of Vienna. If this does not occur, the winners will be informed separately regarding the disposition of the prizes.
Should winners fail to confirm acceptance of the prize or claim it within the 14-business-day period for any reason whatsoever, or fail to collect the prize within the four-week period for any reason whatsoever, their claim to the prize shall lapse. In this case, the Language Center of the University of Vienna reserves the right to select new winners.
Austrian law applies, excluding the conflict-of-laws provisions of international private law. Should any individual provisions of the Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. Such provisions shall be replaced by an appropriate provision that most closely corresponds to the purpose of the invalid provision.
This contest is not affiliated with Facebook/Instagram and is in no way sponsored, endorsed, or organized by Facebook/Instagram. The recipient of the data and information submitted by participants is not Facebook/Instagram, but rather the Language Center of the University of Vienna.
